Use of the Platform

• You must be at least 18 years old and able to form a legally binding contract to use the Platform.
• You agree to use WatchGauge HQ only for lawful purposes and in compliance with these Terms and all applicable laws.
• You are responsible for the accuracy of any information you submit, including watch listings, images, and descriptions.

Quick Offer Service

• The Quick Offer feature allows users to receive indicative purchase offers from verified dealers or trusted partners.
• There is no guarantee that WatchGauge HQ will be able to provide a Quick Offer for every submission.
• All offers, where available, are based on information you provide and are subject to verification, authentication, and market conditions.
• WatchGauge HQ does not guarantee the final sale price, speed of sale, or acceptance of any offer by third parties.

Quick Offer — Additional Terms

1. Nature of Service

The Quick Offer Program ("Program") is operated by WatchGauge HQ ("the Platform") to facilitate the purchase of watches from private Sellers by verified Buyers and dealers within its network. WatchGauge HQ acts as an intermediary to source offers, coordinate authentication, and manage payments.

2. Submission and Offers

2.1 The Seller submits details of a watch via the Instant Offer form, including photographs, brand, model, serial number, and condition.

2.2 WatchGauge HQ obtains one or more offers from verified dealers and presents the highest confirmed price to the Seller.

2.3 The offer is valid for forty-eight (48) hours. Acceptance by the Seller forms a binding agreement subject to authentication.

3. Shipment and Risk

3.1 Upon acceptance, WatchGauge HQ provides a prepaid, insured courier label and shipping instructions to the appointed authentication partner.

3.2 The Seller must dispatch the watch within two (2) business days using the provided label.

3.3 Risk of loss or damage in transit remains with WatchGauge HQ or its nominated carrier once the watch is scanned into the courier system, provided the Seller uses the supplied label and packaging.

4. Authentication

4.1 The watch will be authenticated upon receipt by the Platform's nominated partner to verify authenticity, serial numbers, and condition.

4.2 If the watch passes authentication, the sale is deemed complete and payment is released.

4.3 If authentication identifies discrepancies or a counterfeit, WatchGauge HQ may either issue a revised offer or return the watch to the Seller at the Seller's cost.

4.4 If the Seller rejects the revised offer, the original transaction is void.

5. Payment

5.1 Payment is made via Stripe Connect or another authorised payment provider within twenty-four (24) hours of authentication approval.

5.2 WatchGauge HQ will deduct a six per cent (6%) commission from the final offer amount prior to disbursement.

5.3 Title to the watch transfers to the purchasing dealer upon completion of authentication and payment to the Seller.

6. Seller Warranties

The Seller warrants that: (a) the watch is genuine, authentic, and not counterfeit or stolen; (b) the Seller is the lawful owner and entitled to sell; (c) all information provided is accurate and complete; and (d) no part of the watch has been substituted, replaced, or materially altered since submission.

7. Indemnity

The Seller indemnifies WatchGauge HQ, its directors, officers, and partners against any loss, claim, or expense (including legal costs) arising from breach of warranty, misrepresentation, or the sale of counterfeit or stolen goods.

8. Liability

To the fullest extent permitted by law, WatchGauge HQ's total liability in connection with the Program is limited to the commission it earned from the transaction. Nothing in these Terms limits rights under the Australian Consumer Law.

9. Cancellation and Returns

9.1 The Seller may withdraw prior to shipping. Once the item is shipped for authentication, the transaction cannot be cancelled except under clause 4.3.

9.2 Once payment is made, the sale is final.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of its courts.

Selling on the Marketplace

Payment Handling

All payments are processed by Woopayments. Vendors are responsible for payment processing charges which are approximately 3%. Buyer funds are held by Stripe until the transaction is completed. WatchGauge HQ does not directly receive or hold Buyer funds. Upon confirmation of delivery and expiry of the inspection period, Stripe will release payment to the Seller, less a 6% commission payable to WatchGauge HQ.

Shipping

The Seller must dispatch the item using a tracked and insured courier service approved by WatchGauge HQ and provide tracking within twenty-four (24) hours. Risk of loss or damage remains with the Seller until the courier confirms delivery. Failure to use an approved courier or to insure the item transfers full liability to the Seller.

Inspection Period

Buyers have forty-eight (48) hours from delivery confirmation to notify WatchGauge HQ of any authenticity or condition issues. If no notification is received, the transaction is deemed complete and funds are released automatically. If a valid dispute is raised, WatchGauge HQ may pause payout while the matter is investigated.

Disputes and Refunds

Where an item is found to be counterfeit, materially misdescribed, or not delivered, WatchGauge HQ may refund the Buyer and recover amounts from the Seller, including by reversing the payout. Sellers remain liable for counterfeit or fraudulent items and must indemnify WatchGauge HQ for all related costs.

Liability

WatchGauge HQ acts only as a facilitator between Buyer and Seller. To the fullest extent permitted by law, WatchGauge HQ's liability is limited to the total commission earned on the transaction. Nothing in these Terms excludes rights or remedies available under the Australian Consumer Law.

Contact Information & Communication

• For your safety and the integrity of our marketplace, users must not share personal contact information (including phone numbers, email addresses, or social-media handles) through WatchGauge HQ messages or listings.
• All communication between buyers and sellers must occur through the Platform's messaging system.
• Sharing personal or external contact information to bypass the Platform or transact privately is strictly prohibited and may result in immediate suspension or permanent account removal.

Listings and Sales

• Sellers are responsible for ensuring that all watches listed are authentic and lawfully owned.
• WatchGauge HQ is a facilitator platform only and does not act as agent, buyer, or seller unless explicitly stated.
• We reserve the right to edit, suspend, or remove listings that violate these Terms, contain inaccurate information, or appear fraudulent.

Authentication and Courier Services

• Where authentication or courier services are used, these may involve third-party providers.
• You acknowledge that WatchGauge HQ is not responsible for any delay, loss, or damage incurred during shipment or authentication.
• Fees for such services, if applicable, will be disclosed prior to processing.
• Once dispatched via an approved insured courier, delivery timing is outside WatchGauge HQ's control.

Prohibited Conduct

You agree not to:

• Post false, misleading, or counterfeit listings.
• Attempt to solicit users outside the Platform.
• Upload viruses, scripts, or malicious code.
• Engage in abusive, threatening, or defamatory behaviour.

Disclaimers and Limitation of Liability

• WatchGauge HQ provides the Platform on an "as-is" and "as-available" basis.
• We make no warranties or representations about the accuracy, reliability, or availability of the Platform or any third-party offers.
• To the fullest extent permitted by law, WatchGauge HQ and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform.
• Unless otherwise stated in the listing, change-of-mind returns are not accepted. Returns are only permitted where an item is materially misdescribed, counterfeit, faulty, or not delivered, subject to the Australian Consumer Law.
• If a Buyer initiates a chargeback or payment dispute after funds have been released, the Seller agrees that WatchGauge HQ may recover the disputed amount from the Seller, and the Seller must provide all documentation reasonably requested to defend the claim.
• The Seller is the merchant of record for all transactions. WatchGauge HQ acts solely as a limited payment facilitator and does not take title to goods.
• Buyers must not alter, remove, or tamper with serial numbers, components, straps, or packaging during the inspection period. Any such alteration voids dispute eligibility.
• Buyers are strongly encouraged to record a continuous video of unboxing. WatchGauge HQ may require visual evidence to assess disputes.
• This limitation does not apply to fraud, wilful misconduct, or non-excludable statutory guarantees.

Compliance, Disclaimers & Brand Independence

Independent Platform

WatchGauge HQ is an independent online platform and trading facilitator. We are not an authorised dealer, agent, or distributor of any watch manufacturer, brand, or their affiliates. All trademarks, logos, and brand names displayed on the Platform remain the property of their respective owners and are used solely to identify the products being sold.

No Manufacturer Affiliation

References to brands such as Rolex, Omega, Patek Philippe, Audemars Piguet, TAG Heuer, or any other manufacturer are for descriptive purposes only. WatchGauge HQ is not endorsed by, sponsored by, or affiliated with any watch manufacturer or authorised dealer network.

Authenticity Verification

WatchGauge HQ uses independent authentication partners to verify items where required. Authentication is conducted on a reasonable-care basis only; it does not constitute a manufacturer certification or guarantee.

Consumer-Law Compliance

Nothing in these Terms excludes or limits any rights or remedies that cannot be excluded under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)). Buyers are entitled to consumer guarantees where applicable, and Sellers remain responsible for compliance with all relevant obligations under that law.

Financial Services Disclaimer

WatchGauge HQ does not provide financial, investment, or valuation advice. Any price indications or market data are provided as general information only and should not be relied upon for investment purposes.

Suspension and Termination

• We may suspend or terminate your account at any time without notice if you breach these Terms, share contact details externally, or engage in conduct we consider inappropriate or unsafe.
• Upon termination, your right to use the Platform ceases immediately.

Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts in that State.

Changes to These Terms

WatchGauge HQ may update or amend these Terms from time to time. Updated versions will be posted on our website, and continued use of the Platform constitutes acceptance of the revised Terms.
